Terms

What you agree to by using it.

Last updated November 4, 2026 · Draft, not yet in force

Scout & Cast is a tool a guide uses to run trips and an angler uses to request one. The trip itself is between the two of you. These terms say what the tool does, what we ask of the people using it, and where our responsibility ends.

[LEGAL REVIEW: a draft in plain words, written from how the software works. The clauses marked below need a lawyer’s eye before this is in force.]

What Scout & Cast is

A booking and trip-management tool for fishing guides, with a trip page and recap for their clients. We are not a guide service, a booking agent or a party to any trip. When a guide confirms a trip, that is an agreement between the guide and the angler, on the guide’s terms. We provide the place where it is arranged and recorded.

Money

Scout & Cast takes no payment from anyone. A guide logs what an angler has paid, however it was paid, so the trip shows what is owed; that record is the guide’s, kept by hand. Booking and trip management have no monthly fee and no commission on trips. If that ever changes, the pricing page changes first and signed-in guides are told.

If you are a guide

  • You are responsible for being licensed, insured and permitted to guide where you say you do. Verification marks on your page say what we checked and no more; they are not a guarantee to anyone.
  • What you put on your public page and your trip pages is yours, and it has to be true: the trips, the prices, the waters, the photos, the words.
  • The trips you confirm are your commitments. Cancelling, refunding and rescheduling are between you and the angler, on the policy you set and show on your trip page.
  • You keep the relationship with your clients. We will not contact them on our own behalf unless they asked us to, and we do not sell their details or yours.
  • You decide who is on your team and what they can see. Anyone you invite can see what their role allows, including your anglers’ details.

If you are an angler

  • A request is a request. Nothing is booked, and nothing is charged, until the guide says yes. The screens and emails say so each time.
  • The details you give go to the guide you asked, so they can answer and run the day. Give real ones.
  • The trip page link is private and is yours. Anyone with the link can read the page, so share it only with people on the trip.
  • Whether you need a fishing license is your responsibility. The trip page asks and points you at the state; it does not decide for you.

Your content

What you write, upload or log stays yours. You give Scout & Cast the permission it needs to store it, show it to the people the tool is designed to show it to, and send it in the emails the tool sends. That permission ends when the content is deleted. We do not use your content to promote Scout & Cast without asking you first.

The water comes first

Content that could harm a water, or that breaks tribal or private access limits, comes off the platform, and we may close the account that posted it. So does content that is false, that belongs to someone else, or that is used to harass anyone. This is the one place we will act without being asked.

Spots and catch data

Where you fish and what you caught are never shared with a third party, never sold, and never built into an aggregate. The full promise is on its own page, and these terms do not override it.

Accounts, and leaving

A guide can turn their public page off at any time, and can ask us to close the service. We may suspend an account that breaks these terms, and we will say why.

[DECISION NEEDED: what a guide takes with them when they leave, and what stays for the anglers who already have a recap. The same open question as on the promises and privacy pages. Decide once; all three pages say it.]

What we don’t promise

The tool is provided as it is, built and run by one person at night. It can be down, slow or wrong, and a forecast, gauge reading or map on it comes from someone else and can be wrong too. Use your own judgement on the water. We are not responsible for what happens on a trip, for a guide’s or angler’s conduct, or for money that changes hands between them.

[LEGAL REVIEW: the limitation of liability. The paragraph above is the plain version; a lawyer will want the usual language about consequential damages and a cap, and may want an indemnity from guides. Keep whatever is added readable.]

Disputes and law

[DECISION NEEDED: governing law and venue. Wisconsin is the obvious choice if that is where the business is registered. [LEGAL REVIEW: whether to require informal resolution first, and whether arbitration is wanted at all.]]

Changes

When these terms change, the date at the top changes, and signed-in guides hear about anything that matters by email. Using the tool after a change means you accept it.
